Identification of the Parties

For the purposes of these Terms and Conditions, the parties are identified as follows:

PART ONE — THE COMPANY: Beta Home, Mediação e Investimentos Imobiliários, Lda, with its headquarters at Avenida Amália Rodrigues, No. 26, Loja 1, 2620-520 Ramada, with tax identification number 515 125 458, holder of AMI license No. 26522, registered with the Institute of Public Markets, Real Estate, and Construction (IMPIC), hereinafter referred to simply as “the Company”;

PART TWO — THE USER: any natural or legal person who accesses and uses the website www.betahome.pt (hereinafter referred to as the “Website”), hereinafter referred to simply as “the User.”

1. Purpose and Scope of Application

This document sets forth the Terms and Conditions of Use (hereinafter “Terms”) that govern access to and use of the Website, which is owned by the Company.

The purpose of the Website is to present and advertise properties available for sale and rent; the listings are published exclusively by the Company in the course of its licensed real estate brokerage activities.

Use of the Website implies that you have read, understood, and fully accepted these Terms. If you do not agree with any provision set forth herein, you must refrain from using the Website.

2. Access and Acceptance of the Terms

Access to the Website is free and does not require the User to register or create an account.

Simply browsing the Website or using any of its features implies full and unreserved acceptance of these Terms, as well as the Privacy Policy and Cookie Policy, which are available on the Website.

The Company reserves the right to modify these Terms at any time, without prior notice. The changes will take effect immediately upon their publication on the Website. We recommend that you check this page regularly.

3. Minors

This Website is intended for users 18 years of age or older. If you are a minor, you must obtain consent from your parents or legal guardian before using the services available on the Website, including submitting contact forms.

The Company does not intentionally collect personal data from minors without parental consent.

4. Terms of Use and User Responsibility

All advertisements and content published on the Website are the sole responsibility of the Company. The Website does not allow the publication of advertisements by external users, other real estate agencies, or third parties.

The Company is committed to keeping the published information up-to-date and accurate. However, it does not guarantee the completeness or absolute accuracy of the information provided, particularly with regard to prices, features, and availability of properties, which are subject to change without prior notice.

The photographs, floor plans, and descriptions of the properties are for illustrative purposes only and do not constitute binding contractual terms.

6. Contact Services

The Website provides contact forms that allow the User to communicate with the Company. Sending messages through these forms does not create any contractual relationship between the User and the Company.

7. Intellectual and Industrial Property

All content on the Website, including, but not limited to, text, images, photographs, logos, trademarks, graphics, videos, and software, is the property of the Company or of third parties who have granted authorization for its use, and is protected by Portuguese and European copyright and intellectual property laws.

The reproduction, distribution, adaptation, public communication, or any other form of use of the aforementioned content is expressly prohibited without prior written authorization.

Use of the Website does not grant the User any intellectual property rights to the content made available on it.

8. Limitation of Liability

The Company does not guarantee the continuous and uninterrupted availability of the Website and may temporarily suspend it for maintenance or technical reasons, without this giving rise to any right to compensation.

The Company is not liable for:

  • Errors or omissions in the published content;
  • Damages resulting from interruptions, technical failures, or computer viruses;
  • Decisions made by the User based on the information available on the Website;
  • Content from third-party websites to which the Website may contain hyperlinks.

9. Links to Third-Party Websites

The Website may contain hyperlinks to third-party websites, including real estate portals. These hyperlinks are provided solely for the User’s convenience and do not imply any endorsement, sponsorship, or liability on the part of the Company with respect to the content of those websites.

The inclusion of hyperlinks to third-party websites on the Company’s Website does not imply any association or formal partnership with those third parties.

10. Mapping Services and External Tools

The website uses third-party mapping services to display the locations of properties, specifically:

  • OpenStreetMap — available under the Open Database License (ODbL). Use of this service is subject to the OpenStreetMap Foundation’s Privacy Policy (osmfoundation.org).
  • Google Maps (embedded version) — provided by Google LLC. Embedding this service may involve the transmission of certain technical data about the User to Google’s servers, in accordance with Google’s Privacy Policy (policies.google.com). The Website uses the embedded version without a custom API key.

The Company does not control the data collected by these external services and recommends that you review their respective privacy policies.

11. Protection of Personal Data

The processing of personal data in connection with the use of the Website is governed by the Company’s Privacy Policy, available at www.betahome.pt/politica-de-privacidade, which was drafted in accordance with the General Data Protection Regulation (GDPR — Regulation (EU) 2016/679) and Law No. 58/2019, of August 8.

12. Multilingual Website

The website is available in multiple languages, including Portuguese and English, and may include other languages in the future. In the event of any discrepancy between language versions, the Portuguese version will always take precedence.

These Terms are effective indefinitely and may be amended or revoked at any time.

The Company reserves the right to restrict, suspend, or terminate access to the Website, in whole or in part, at any time and without prior notice, particularly in the event of a violation of these Terms.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with Portuguese law.

Any dispute arising from the interpretation or enforcement of these Terms shall be subject to the jurisdiction of the courts of the District of Lisbon, with an express waiver of any other forum.

The Company hereby states that it is not bound by the use of alternative dispute resolution mechanisms with consumers, without prejudice to the consumer’s right to resort to the alternative dispute resolution entities provided for under Portuguese law, namely the National Center for Information and Arbitration of Consumer Disputes (CNIACC) or other legally authorized consumer dispute arbitration centers.
